[180114.EN.SEA] MOL to Sell 49pc of Terminals in LA-Long Beach, Oakland, Jacksonville

JAPAN's Mitsui OSK Lines (MOL) has confirmed that it is negotiating with Toronto fund manager Brookfield Asset Management to sell 49 per cent of its US terminal assets, reports Lloyd's List.

Through MOL's TraPac subsidiary, which owns American terminals in Long Beach, Oakland and in Jacksonville, the sale will be made to Brookfield, which also owns PD Ports in the UK.

In an emailed statement to Lloyd's List, MOL said: "We are now under discussion with Brookfield Asset Management to establish a cooperation scheme, not only to add value to our container terminals in the United States, but also to consider further expanding co-operation coverage to their key strategic ports in various countries which complement our extensive liner network."

Brookfield has US$175 million under management and a 100-year history of owning property and operating, infrastructure and renewable power projects.

The Port of Los Angeles said it would be a "cash transaction purchasing existing shares with no new shares being issued and carrying out an incentive payment if certain volume criteria are met".

It goes on to say that although MOL would retain the 51 per cent, the deal involves a supermajority - more 50 per cent - before any major decision of budgets and strategy and senior executive compensation could be taken.

In 2009, Brookfield formed a new holding company, Brookfield Ports (UK) Ltd, to complete the purchase of PD Ports from Australia's Babcock & Brown Infrastructure (BBI), then owner of the Hull Container Terminal.

[180114.ID.BIZ] Alokasi Eks Frekuensi Axis ke XL Dinilai Tidak Fair

Bisnis.com, JAKARTA - Pengalokasian frekuensi bekas Axis ke XL di pita 1.800 MHZ dinilai tidak ada dasarnya, karena membuat XL frekuensinya sama dengan Telkomsel, padahal jumlah pelanggan Telkomsel jauh lebih besar.

“Hal itu menunjukkan tidak ada prinsip keadilan,” ujar Gunawan Wibisono, pengamat telekomunikasi dari UI.

Dia juga menilai Menkominfo seolah bertindak sendiri dalam memutuskan merger XL-Axis. Tim Ad Hoc yang dibentuk pun hanya berisi orang-orang BRTI.

Menurutnya, keputusan merger itu merupakan buah kompromi dan yang memberikan masukan pun BRTI yang notabene merupakan bawahan menteri.

“Sejak awal proses merger ini sudah salah karena pemerintah  melanggar Pasal 25 ayat 1 PP No. 53 Tahun 2000,” ungkapnya.

Sebaliknya, sambungnya, Kemenkominfo berlindung pada Pasal 2,  padahal sebenarnya yang boleh diizinkan menteri hanya ISR,  bukan frekuensinya.

Gunawan melihat hal itu sebagai keanehan, karena BRTI sebagai regulator melakukan pengkondisian pasar yang seharusnya terjadi secara natural.

Namun, anggota BRTI Nonot Harsono menjelaskan rekomendasi tim yang tertulis memang tidak ada yang sesuai dengan keputusan Menkominfo, tetapi rekomendasi yang lisan jauh lebih banyak.

“Menkominfo  memilih salah satu saja. Pemerintah tidak menempuh kata pengembalian, tapi rebalancing atau pengaturan ulang,” jelasnya.

Hasil akhir dari penataan frekuensi adalah keseimbangan daya saing dari tiga besar, yakni Telkomsel, Indosat, dan XL.

Pelaksana Tugas Sekretaris Perusahaan IPC Rima Novianti, melalui keterangan persnya sore ini, Rabu (15/1/2014), menyatakan pelabuhan merupakan fasilitas vital yang tidak boleh terhenti untuk memberikan pelayanan kepada publik.

Oleh sebab itu, kata dia, 12 kantor pelabuhan yang dikelola oleh Pelindo II dan seluruh operator terminal yang berada di lingkungan Pelabuhan Tanjung Priok, yaitu JICT, TPK Koja, dan MTI berkomitmen terus beroperasi memberikan pelayanan jasa kepelabuhanan.

“Semua fasilitas di pelabuhan akan tetap beroperasi dan menjaga agar kelancaran layanan terhadap kegiatan jasa kepelabuhanan dapat berjalan dengan baik,” ujarnya.

Saat ini, Pelindo II mengelola 12 cabang pelabuhan di seluruh Indonesia yakni Pelabuhan Tanjung Priok, Panjang Bandar Lampung, Palembang,Pontianak, Teluk Bayur Sumatera Barat, Cirebon,Jambi,Banten,  Bengkulu, Sunda Kelapa, Pangkal Balam, dan Pelabuhan Tanjung Pandan.

Dia menegaskan, Tanjung Priok sebagai pelabuhan tersibuk di Indonesia akan tetap beroperasi seperti biasa, termasuk tetap mengoperasikan 6 kapal pandu dan 13 kapal tunda untuk pelayanan kapal.

“Pada 16-17 Januari 2014, JICT juga akan melayani bongkar muat 9 kapal dan di TPK Koja ada 6 kapal ekspor impor,” ujarnya.

[160114.EN.SEA] Japan Expected to Fine NYK, 'K' Line, WWL For Price Fixing

SOME US$210 million in price-fixing fines in automobile shipping is expected to be awarded to Japan's NYK, "K" Line and Norway's Wallenius Wilhelmsen Logistics (WWL), Reuters reports.

The companies, together with MOL unit Nissan Motor Car Carrier, as well as Norway's Wallenius Wilhelmsen, said they have received a draft fine from Japan's Fair Trade Commission.

WWL faces a $33 million fine, one of its parent companies said. The three other companies declined to comment on the details of the draft order, but the total fine is said to be Japan's second highest for price fixing.

The four companies are alleged to have conspired to fix the prices of auto shipments from Japan to North America and Europe, a source said.

Regulators in the United States and Europe are also probing the case, a source said.

"We will carefully study this draft order and consider how to respond," NYK said in a statement.

Japan is likely to issue a final ruling by the end of March, the source with close knowledge of the matter said.

The four companies as well as Mitsui OSK Lines (MOL) and EUKOR Car Carriers said they have been under investigation from the Japanese regulator.

MOL is expected to seek leniency in exchange for cooperation, Japanese media reported. EUKOR Car Carriers, held 40 per cent by WWL, has not been named in the draft orders, WWL said.

Seperti yang dilansir dari situs recode.net, investasi Bakrie tersebut akan menambah total investasi di Path senilai US$65 juta. CEO Path David Morin mengatakan pihaknya selalu mencari strategi untuk membidik pasar Asia.

"Saya selalu mencoba memahami mengenai sasaran pasar dan mencari parter lokal untuk ekspansi," ujarnya seperti yang dikutip dari Recode, Sabtu (11/1/2014).

Sekitar 23 juta orang diseluruh dunia memiliki akun Path. Untuk mengembangkan situs ini, Morin berencana akan meluncurkan empat versi layanan di Path.

CEO Bakrie Group Anindya Bakrie mengatakan pihaknya sangat tertantang untuk perusahaan yang meraup laba US$10 juta pada 2011. Laba tersebut diperoleh setelah Path diperkenalkan pada November 2010.

Path merupakan situs jejaring sosial yang mengutamakan privasi. Seperti halnya Facebook, situs ini juga mengundang dan menerima seseorang untuk terhubung.

Namun, Path hanya menyediakan ruang sebanyak 150 kontak. Oleh karena itu, situs ini merekomendasikan hanya orang-orang terdekat seperti teman dekat dan keluarga yang bisa saling terhubung.

[150114.EN.AIR] Swiss Competition Body Fines Cathay, SIA For Cartel Dealings

SWISS competition commission WEKO has fined 11 airlines CHF11 million (US$12 million) after it found they had colluded in an air freight pricing cartel, Reuters reported.

WEKO said that the airlines included Cathay Pacific, Singapore Airlines, Japan Airlines, British Airways, United Continental, American and Air France.

The airlines agreed on freight rates, fuel surcharges, war-risk surcharges, customs clearance surcharges for the United States and the commissioning of surcharges, which together contribute to the price of air freight transport, between 2000 and 2005, WEKO said.

WEKO said that Lufthansa escaped a fine because it informed on the others.
